    The terms of service governs your use of Hyperboards. Please scroll down and read the entire document. If you do not agree with the terms set forth by our service, then you won't be able to proceed with the Hyperboards registration process and you will become neither a Hyperboards forum owner, nor a Hyperboards member.
  1. Changes to the Terms of Service:
    Hyperboards reserves the right to change the terms of this agreement at any time. The changes will appear in this document, which you can access at any time by clicking on the 'T.O.S.' link on the Hyperboards homepage. Your use of Hyperboards after changes are made to this agreement means that you agree to be bound by such changes.
  2. Privacy:
    Registration data and other information about you is subject to our Privacy Policy. If you are located outside of the United States, note that information that you provide to us is being sent to the United States. By subscribing to Hyperboards, you consent to your data being sent to the United States. Please read our Privacy Policy for more information.
  3. Services:
    1. Access to utilize the Hyperboards forums.
    2. Access to utilize the ad-free service for the Hyperboards forums.
  4. Fees and Payments:
    Hyperboards is a free service and does not impose any fees upon its users. However, payments can be made to Hyperboards for its ad-free service on a specific forum. Ad-free prices are subject to change at any time and current ad-free prices will be posted on every Hyperboards forum.
  5. Renewal:
    Hyperboards does not require normal members to renew their accounts in any way. Forums with the ad-free service are not subject to auto-renewal. Additional ad-free payments must be made once the ad-free service is depleted. Ad-free service payments can be made through the PayPal service only.
  6. Limitations on Use:
    1. You agree to refrain from using 'ad-blockers' such as 'pop-up blockers' and the use of 'scripts' or html in order to disable or hide any and all advertisements found on any and all Hyperboards forums. If you are using a browser with a built in 'pop-up blocker' you agree to disable the 'ad-blocking' feature on your browser. Hyperboards reserves the right to terminate any and all accounts that fail to comply with this term.
    2. You agree to refrain from posting content containing adult content, pornography, racism, hate, spam, and content promoting illegal activities, such as fraud, illegal drugs, prostitution, child pornography, mlm, pyramid schemes, and any other illegal activities.
    3. You agree not to use Hyperboards for any unlawful purpose. We reserve the right to terminate or restrict your access to Hyperboards if, in our opinion, your use of Hyperboards may violate any laws, infringe upon another person's rights or violate the terms of this agreement. Also, we may refuse to grant you a username that impersonates someone else, is protected by trademark or other proprietary right law, or is vulgar or otherwise offensive.
  7. Indemnification:
    1. If you are creating a Hyperboards forum or if you are the 'MainAdmin' of a Hyperboards forum, you agree to indemnify, hold harmless and defend at your own expense Hyperboards from any and all claims, actions, proceedings, expenses, damages and liabilities (including reasonable attorney's fees), arising out of or in connection with the content of your Hyperboards forum.
    2. You agree to indemnify, hold harmless and defend at your own expense Hyperboards from any and all claims, actions, proceedings, expenses, damages and liabilities (including reasonable attorney.s fees), arising out of or in connection with the content of any Hyperboards forum. In other words, you agree to refrain from prosecuting Hyperboards for any and all content found on any and all Hyperboards forums.
  8. DISCLAIMERS OF WARRANTIES AND LIMITATIONS ON LIABILITY:
    YOU AGREE THAT YOUR ACCESS TO AND USE OF HYPERBOARDS AND THE CONTENT AVAILABLE THROUGH HYPERBOARDS IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. HYPERBOARDS GIVES NO WARRANTY, EXPRESSED OR IMPLIED, FOR THE SERVICES PROVIDED, INCLUDING, WITHOUT LIMITATION, WARRANTY OF MERCHANTABILITY AND WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. THIS NO WARRANTY EXPRESSLY INCLUDES ANY REIMBURSEMENT FOR LOSSES OF INCOME DUE TO DISRUPTION OF SERVICE BY HYPERBOARDS OR ITS PROVIDERS BEYOND THE FEES PAID BY CLIENT TO PROVIDER FOR SERVICES. WE MAKE EVERY EFFORT TO BACKUP OUR DATA, BUT WE ARE NOT RESPONSIBLE FOR ANY LOSS OF DATA.

    HYPERBOARDS AND ITS SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES AND LICENSORS WILL NOT BE LIABLE (JOINTLY OR SEVERALLY) TO YOU OR ANY OTHER PERSON AS A RESULT OF YOUR ACCESS OR USE OF HYPERBOARDS FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST SAVINGS AND LOST REVENUES (COLLECTIVELY, THE "EXCLUDED DAMAGES"), WHETHER OR NOT CHARACTERIZED IN NEGLIGENCE, TORT, CONTRACT, OR OTHER THEORY OF LIABILITY. IF ANY APPLICABLE AUTHORITY HOLDS ANY PORTION OF THIS SECTION TO BE UNENFORCEABLE, THEN THE HYPERBOARDS PARTYS. LIABILITY WILL BE LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY APPLICABLE LAW.
